Workers' Comp vs. Personal Injury in Arizona: Which Claim Do You Actually Have?

Injured on the job in Arizona? You may have a workers' comp claim, a personal injury claim, or both. Here's how to tell the difference — and why it matters.

When an Arizonan is hurt at work, the reflex is "that's a workers' comp case." Often true — but frequently incomplete, and the difference can be worth many times the value of the comp claim alone.

How the two systems differ. Workers' compensation is no-fault insurance administered through the Industrial Commission of Arizona: it pays medical care and a portion of lost wages regardless of who caused the injury, and in exchange you generally cannot sue your employer. Personal injury is a fault-based claim against whoever negligently caused your harm, and it covers what comp never does — full lost wages and pain and suffering.

The overlooked scenario: the third-party claim. Arizona law lets an injured worker pursue BOTH when someone other than the employer shares fault. The delivery driver rear-ended on the Loop 202 while working has a comp claim and a personal injury claim against the at-fault driver. The warehouse worker hurt by defective equipment may have a product-liability claim against the manufacturer. The construction worker injured by another company's subcontractor may have a claim against that contractor. In each case, comp pays now — and the third-party claim pursues the rest.

Why the distinction is time-sensitive. Comp claims have short reporting windows, while third-party claims run on Arizona's two-year statute of limitations — and comp carriers hold liens against third-party recoveries that must be handled correctly. Sorting out which claims exist is one of the most valuable things an attorney does in a work-related injury, and it should happen early.
